Full terms and conditions

All material in the Göteborg & Co Media Bank is protected by copyright law. The term material refers to images and films. The material from this Media Bank may be used free of charge by anyone wishing to use the material for the purpose of showcasing and communicate about Gothenburg as a destination. This is applicable to information in both print and digital media. Marketing of other products or services are prohibited.

Material in the Media Bank showing an identified or identifiable natural person constitutes personal data under the EU General Data Protection Regulation, GDPR. The user is the data controller for their own processing of personal data when using material from the Media Bank. The user shall process personal data in accordance with the GDPR.

By downloading material from the Media Bank, the user accepts the terms of use. The terms of use are binding on all users. “User” refers to the person, organisation or company using the image. The user is responsible for indemnifying Göteborg & Co from claims from the holder of the rights to the image in connection with any use that violates the terms of use.

When the image is used, the name of the photographer must be stated as follows: Name of photographer/Mediabank Göteborg & Co.

The user may be charged for omitting the name of the copyright owner and/or the rights holder in instances where no name is provided.

The user has a non-exclusive and non-transferable right to use images from the Göteborg & Co Media Bank. The images may not be transferred, licensed, sold, copied, or distributed to third parties. The right to use the image must be exercised within six (6) months after the image has been downloaded. The user may not save the image for purposes other than the specific purpose for which the image was downloaded. In this case, the image must be re-downloaded from the Göteborg & Co Media Bank before it can be used so as to accept the terms of use for the image once more and ensure that it is still available.

It is permitted to use the material in a context where the destination Gothenburg is displayed or communicated, for example by a company that represents Gothenburg abroad (in customer magazines, presentations, events or similar) as long as the company’s product or service is not marketed directly. Using the material without a clear connection to Gothenburg as a destination is not permitted.

Material from the Göteborg & Co Media Bank may not be used in any manner that is incompatible with Swedish or international law. The material must not be used or placed in a context that could be perceived as offensive, misleading, or unlawful. The material must not be used in a way that may offend or insult the Photographer and/or the person(s) pictured. The material may not be distorted or altered – beyond normal editing – without the permission of the originator. The user is liable for any claims for damages that may be filed by the originator of the image or by persons pictured because of inappropriate use.

The images are not intended for private use.

Responsibility for image publication always rests with the user. The user may be subsequently charged directly by the Photographer in cases where the conditions for the use of images are not complied with. Göteborg & Co is not responsible towards the originator who makes a claim for the user’s unauthorized use.

Disputes concerning the interpretation or application of these terms of use shall be settled shall be decided by a Swedish general court, with Gothenburg District Court as the court of first instance.
