• The material may not be used to promote products or services other than to promote and/or showcase Gothenburg as a destination.

• When the material is used, the name of the photographer must be stated as follows: Name of photographer/Mediabank Göteborg & Co.
• Anyone using material from the media bank is a data controller and must comply with the GDPR

Full terms and conditions

All material in the Göteborg & Co Media Bank is protected by copyright law. Images from this Media Bank may be used free of charge by anyone wishing to use images for the purpose of promoting and/or showcasing Gothenburg as a destination. This is applicable to promotion in both print and digital media. Marketing of other products or services are prohibited.

Material in the Media Bank showing an identified or identifiable natural person constitutes personal data under the EU General Data Protection Regulation, GDPR. The user is the data controller for their own processing of personal data when using material from the Media Bank. The user shall process personal data in accordance with the GDPR.

The user must personally download the image from the Media Bank and accept the terms of use. The terms of use are binding on all users. “User” refers to the person, organisation or company using the image. The user is responsible for indemnifying Göteborg & Co from claims from the holder of the rights to the image in connection with any use that violates the terms of use.

When the image is used, the name of the photographer must be stated as follows: Name of photographer/Mediabank Göteborg & Co.

The user may be charged for omitting the name of the copyright owner and/or the rights holder in instances where no name is provided.

The user has a non-exclusive and non-transferable right to use images from the Göteborg & Co Media Bank. The images may not be transferred, licensed, sold, copied, or distributed to third parties. The right to use the image must be exercised within six (6) months after the image has been downloaded. The user may not save the image for purposes other than the specific purpose for which the image was downloaded. In this case, the image must be re-downloaded from the Göteborg & Co Media Bank before it can be used so as to accept the terms of use for the image once more and ensure that it is still available.

Use of the images in a commercial context where the Gothenburg as a destination is showcased or promoted by a company representing Gothenburg abroad (in customer magazines, presentations, events or similar), for example, as long as the company’s product or service is not promoted directly. Using the image without a clear link to Gothenburg as a destination is not considered to promote Gothenburg and is therefore prohibited. Nor is it sufficient for the company to have Gothenburg or references to Gothenburg in its name, profile, payoff or similar.

Images from the Göteborg & Co Media Bank may not be used in any manner that is incompatible with Swedish or international law. The images must not be used or placed in a context that could be perceived as offensive, misleading, or unlawful. The images must not be used in a way that may offend or insult the Photographer and/or the person(s) pictured. Images may not be distorted or altered – beyond normal editing – without the permission of the originator. The user is liable for any claims for damages that may be filed by the originator of the image or by persons pictured because of inappropriate use.

Göteborg & Co bears no liability for clarifying additional usage rights and is not liable to any photographer/rights holder who makes a claim for unauthorised use. Any other use of the images must therefore be agreed separately with the Photographer/rights holder.

The images are not intended for private use and may not be submitted to third parties.

Responsibility for image publication always rests with the user. The user may be subsequently charged directly by the Photographer in cases where the conditions for the use of images are not complied with.

Disputes concerning the interpretation or application of these terms of use shall be settled shall be decided by a Swedish general court, with Gothenburg District Court as the court of first instance.
